Should the owner be allowed to develop light industrial?

Light Industrial land uses historically have included low-polluting operations with normal operating hours, which are compatible with residential areas. Light industrial land uses should conform with the comprehensive plan’s standards for compatible development with the surrounding area. JeffCo’s zoning resolutions for light industrial have gaps, with no category for operations that combine heavy industrial (i.e., trucking centers) distribution and warehousing of goods.

Can zoning regulations be changed?

Yes. The County does so and can do so. In 1958, this site was originally zoned agricultural and was changed to light industrial. Kerr McGee, the Colorado School of Mines Research Institute, and AMAX constructed small one and two-story office buildings serviced by small parking lots.

Can the county prevent this project from being a heavy industrial site?

Yes. Placing a moratorium on building permits for logistics distribution centers built on in-fill properties within 500 feet of established residences will give the county time to complete its ongoing efforts to update zoning and land use regulations.
